1. Data controller
The data controller is Kancelaria Adwokacka adw. Anna Marcinkowska, 270 Piotrkowska Street, 90-361 Łódź, 13th floor. Privacy enquiries may be sent to kancelaria@adwokat-marcinkowska.pl or made by telephone on +48 888 771 712.
2. Data that may be processed
Depending on the form of contact, this may include identification and contact details, data concerning other participants in the matter, information provided in the description, documents, billing data, communication history and technical data concerning use and security of the website.
Legal matters may involve special categories of personal data, including health data, and data relating to criminal convictions and offences. Such data is processed only where necessary and on an appropriate legal basis, in particular for the establishment, exercise or defence of legal claims or the provision of legal assistance subject to professional secrecy.
3. Purposes and legal bases
- responding, checking for conflicts of interest and taking steps before a contract is concluded;
- booking, preparing and providing a consultation or another agreed service;
- complying with legal, tax, accounting and professional obligations;
- protecting rights, communication security and establishing, pursuing or defending claims;
- publishing informational content and—only after the required consent has been obtained—sending requested information.
Depending on the situation, processing may be based on performance of a contract, steps taken at the person's request before a contract, a legal obligation, legitimate interests, consent, or a basis provided for special categories of data and data concerning criminal convictions and offences.
4. Conflicts of interest and data minimisation
The booking form collects only the data required for contact and to check whether the law office may handle the matter. Documents should not be sent before confirmation. Once the check is complete, the law office provides an individual upload channel that remains active for a limited period.
5. Recipients and service providers
Data may be entrusted to providers of hosting, email, file storage, video conferencing, calendar, payment, accounting and technical-support services. Data is transferred only to the extent necessary and under appropriate agreements.
Where a matter requires a valuer, translator, OSINT analyst, digital forensics specialist or another expert, the scope of data shared and the rules governing their involvement are determined with due regard to professional secrecy.
6. Retention period
Data is retained for as long as necessary for the purpose for which it was collected and subsequently for the period required by legal obligations, professional rules and limitation periods. Files sent solely for a one-off consultation are deleted according to the adopted schedule if no further engagement follows and there is no basis for longer retention.
7. Recording consultations
Consultations are not routinely recorded. If a recording is required for a specified purpose, the purpose, legal basis, access rules, retention period and method of exercising participants' rights will be defined separately before recording begins.
8. Rights of data subjects
Within the limits provided by law, a data subject may request access, rectification, erasure, restriction of processing or data portability. The person may also object or withdraw consent without affecting the lawfulness of processing carried out before withdrawal. The person also has the right to lodge a complaint with the President of the Polish Personal Data Protection Office.
9. Security and transfers
The law office selects technical and organisational measures appropriate to the confidential nature of the information, including access controls, retention limits, encryption in transit and backups.
10. Cookies and measurement
In its basic version, the website will use only mechanisms necessary for operation and security. Analytics or marketing tools requiring consent will not be activated before a mechanism allowing consent or refusal has been implemented.
The interactive map on the About Me and Contact pages is retrieved from OpenStreetMap only after the Display Interactive Map button is selected. Once activated, the browser connects to the external service, which receives the technical data needed to display the map. The service's processing rules are set out in the OpenStreetMap Foundation Privacy Policy.
