Online Consultation Terms

This translation is provided for information. The Polish-language version is the governing text.

1. Service provider

The service provider is Kancelaria Adwokacka adw. Anna Marcinkowska, 270 Piotrkowska Street, 90-361 Łódź, 13th floor, NIP 7262487076, REGON 101848640, number on the roll of attorneys-at-law 5569, e-mail: kancelaria@adwokat-marcinkowska.pl, tel. +48 888 771 712.

2. Nature of the consultation

  1. An online consultation includes up to 50 minutes of conversation with attorney-at-law Anna Marcinkowska via Google Meet and a preliminary review of up to 5 short documents accepted by the law office.
  2. The consultation is intended to identify the situation, provide legal information or indicate possible next steps within the scope agreed before the meeting.
  3. Booking a consultation does not automatically mean accepting an engagement to conduct the matter, represent the client in court or draft a document.
  4. A separate engagement is accepted after a conflict-of-interest check and an assessment of the scope of work, deadlines and ability to give the matter due attention. If an important reason for refusing legal assistance exists, the law office informs the person concerned.
  5. The law office does not guarantee any particular decision or outcome.

3. Booking and conflicts of interest

  1. The client provides contact details, the details of other parties required for the conflict-of-interest check and a brief, as neutral as possible description of the matter.
  2. Until the absence of a conflict has been confirmed, the client should not send complete documents, special categories of personal data or detailed information protected by confidentiality.
  3. Selecting a time in Google Calendar creates a provisional booking. Google's automatic email confirms that the time has been submitted, but it is not final confirmation of the consultation or acceptance of the matter.
  4. The date is confirmed after the possibility of providing the consultation has been verified and the advance has been credited.
  5. The calendar offers times with the minimum lead time required for verification and preparation. If the advance or the complete set of agreed documents arrives too late, the law office may propose rescheduling.
  6. If the law office cannot provide the consultation because of a conflict of interest or another professional impediment, the amount collected is refunded in full.

4. Price and payment

  1. The consultation price is PLN 500 gross unless the information displayed before payment specifies another amount.
  2. Once the possibility of providing the consultation has been verified, an advance equal to 50% of the price, i.e. PLN 250, is collected. It is credited towards the total consultation price and is not a cancellation fee.
  3. The remaining price should be paid no later than 24 hours before the consultation unless the parties agree otherwise.
  4. Payments are processed by an external provider identified during the payment process. The law office does not store complete card details or online-banking credentials.

5. Documents

  1. Once the absence of a conflict has been confirmed, the client receives an individual link for sending up to 5 files in the formats and within the limits indicated during upload.
  2. Documents should be legible, complete and relevant to the question specified when booking.
  3. More extensive material may require a separate quotation or selection of the documents most relevant to the consultation. The law office provides information about this before undertaking additional work.
  4. The client should not send unlawfully obtained material. In case of doubt, the client should first describe the type of material without attaching the file.

6. Consumer's right of withdrawal

  1. A consumer entering into a distance contract may, as a rule, withdraw within 14 days under the applicable law.
  2. If performance is to begin before the end of the 14-day period, the law office will ask the consumer to expressly request that performance begin before that period expires.
  3. If the consumer validly withdraws after performance has begun, the consumer bears a cost proportionate to the part of the service performed before the law office was informed of the withdrawal.
  4. The right of withdrawal may expire after the service has been fully performed if performance began with the consumer's express prior consent and after the consumer was informed of, and acknowledged, the consequence of full performance.
  5. The advance is not automatically and unconditionally non-refundable. Its settlement takes account of consumer law, the timing of cancellation and the actual extent of work already performed.

7. Rescheduling, lateness and non-attendance

  1. The client should request a change of date without delay. If the request is made at least 24 hours in advance, the law office will generally permit one change without an additional fee.
  2. In the event of later cancellation or non-attendance, work already performed is settled, including the agreed review of documents and preparation. The remaining amount paid is settled in accordance with the law and the circumstances of the booking.
  3. The client's lateness does not automatically extend the consultation. If the delay is attributable to the law office, the meeting will be extended accordingly or another date will be agreed.

8. Conduct of the meeting and security

  1. The client is responsible for a suitable device, a stable connection and a location that ensures the confidentiality of the conversation.
  2. The meeting link is intended only for the person making the booking and the agreed participants.
  3. Consultations are not routinely recorded. Recording audio or video by either party requires a prior, express arrangement consistent with the law and data-protection rules.
  4. In the event of a technical failure, the parties will attempt to reconnect, use an agreed alternative channel or arrange a new date.

9. Complaints and contact

  1. A complaint concerning the service may be sent to the law office's email address, identifying the booking, describing the concerns and stating the expected manner of resolution.
  2. The law office will respond within the period required by applicable law and, where no additional findings are required, no later than within 14 days.
