The current position of the matter must be established.

A recommendation requires determining what the available material shows, what remains unknown and which risks persist.

A matter may simultaneously involve procedural deadlines, documents, family circumstances, financial obligations or business operations. Each of these elements may affect the choice of the next step.

I organise the facts and documents. I explain what has been established, what information is still required and what the next step depends on. You make the decision after considering the available options and their consequences.

I inform you about completed steps, current findings and the reasons for the proposed next action. I explain the legal terminology used.

I am personally responsible for the legal strategy, communication with you and the coherence of the work covered by the engagement. You know who is handling the matter and whom you can ask.

Where technical or sector-specific expertise is required, I work with an appropriate specialist, including in OSINT, digital forensics, valuation, accounting or translation.

Experience helps assess risk, but it does not determine the outcome.

The court, the evidence and the course of the proceedings determine the decision. I therefore do not give procedural guarantees or present a possible outcome as certain.

I identify the strengths and weaknesses of the position, as well as the possible costs, duration and consequences of individual actions. I update the strategy when the evidence or the procedural situation changes.

The engagement defines the scope of the work. Within that scope, I prepare the matter, represent the client and take action consistent with the law and the client's interests.

I remain responsible for the legal strategy and communication with you. I do not, however, replace an OSINT analyst, digital forensics specialist, valuer, accountant or translator. I work with professionals in these fields and involve them when the scope of the matter requires their expertise.

Before involving a specialist, I agree with you the purpose and scope of their work, the anticipated cost, and the rules governing the transfer and protection of information. I coordinate their work and combine their findings with the legal assessment.

Conditions for accepting an engagement

I do not accept more matters than I can handle with due care.

Before accepting an engagement, I check for conflicts of interest. I also assess the scope of assistance required, the deadlines and the time needed to perform the work. I accept an engagement when the organisation of the practice allows the work to be carried out with due professional care.

If my current workload does not allow me to devote the necessary time to the matter, or if another important reason exists, I explain the refusal and provide the reason. Separate statutory rules apply to court-appointed matters.
